Are Your Jurors Using Smartphones and Social Media During Trial?

Here’s a link to my interview yesterday with Lawyers.com reporter Keith Ecker. Keith’s article is entitled “Juror Use of Social Media, Blogs Compromises Cases”.

They say “timing is everything,” and I agree. On the same day that Keith’s article came out, a local juror here in Santa Ana, California, was dismissed from a murder trial for posting updates and pictures on Facebook.

I’d like to hear your thoughts and comments on the Lawyers.com article. I even shared a question in the comment section concerning whether or not trial lawyers should encourage their clients to add accurate and favorable content to their social media platforms during the litigation process (planting seeds) to help make sure good content is available online should a juror violate the court’s order and independently do an online search?
